TERMS AND CONDITIONS OF ONLINE SALES

RECITALS

These Terms and Conditions of online sales are entered into between:

  • PSG MERCHANDISING SAS, for the first part, a simplified joint-stock company with share capital of 40,000 Euros, registered with the Trade and Companies Register of Paris under No. B 451 680 458, whose registered offices are located at 24, rue du Commandant Guilbaud – 75016 PARIS – Telephone 01 41 41 61 00 (toll-free call, excluding any operator charges) – Intracommunity VAT No. FR 80451680458, Internet address accueil@psg.fr (hereinafter, “PSG MERCHANDISING”) and,
  • for the second part, any consumer, within the meaning of the Law, namely any natural person not acting as a merchant and having the legal capacity to enter into a contract, but acting exclusively on their own behalf (hereinafter, the “CUSTOMER”), who would like to make a distance purchase of one or more items (hereinafter, the “Order”) on the Paris Saint-Germain website located at the URL address https://store.psg.fr (hereinafter, the “Site”),

Hereinafter referred to together as the “Parties.”

The Parties hereby agree that their relations will be governed by these terms and conditions of sale (hereinafter, the “Terms and Conditions of Sale”) and the confirmation email sent by PSG MERCHANDISING to the CUSTOMER to confirm its Order, which formalise the contract entered into between PSG MERCHANDISING and the CUSTOMER.

The Terms and Conditions of Sale are supplemented by the “Personal Data Protection Policy” page. All Orders imply the acceptance of these Terms and Conditions of Sale and of the “Personal Data Protection Policy” page, without prejudice to the special contractual terms concluded between the Parties and all other terms and conditions contained in another document (prospectus, catalogue, etc.).

PSG MERCHANDISING reserves the right to adapt, amend, or update the Terms and Conditions of Sale at any time, and without advance notice. In the event of an adaptation, amendment, or update, the Terms and Conditions of Sale in effect on the day the Order is placed shall be applied to each Order.

The CUSTOMER has the option to print out the Terms and Conditions of Sale and to read them at any time on the Site, particularly when placing the Order.

1. ORDERING ON THE SITE

All Orders imply a payment obligation. Thus, the CUSTOMER declares and warrants that he is over the age of 18 and has the legal capacity, or if he is a minor, he warrants that he has parental permission to place his Order.

The Order is placed after the completion of the following four successive steps:

a-Selection of items

Before all Orders, the CUSTOMER is asked to read the description of each product in order to understand its characteristics.

After clicking on the “Add to basket” button and after verifying the specifics of their Order (item, quantity, size, colour, price, etc.) from the references of offerings visible on the Site, the CUSTOMER confirms the choice of the item(s) selected by clicking on the “CONFIRM MY BASKET” button.

Information on the availability of the item(s) is provided when the Order is placed.

The CUSTOMER may verify the contents of their basket at any time during the ordering process.

b-Identification

If the CUSTOMER is already registered in the CUSTOMER database, he fills out the fields provided, entering his login ID and personal password.

If the CUSTOMER is not registered in the CUSTOMER database, he fills out the fields provided on the Site, providing his contact information with the following mandatory mentions: title, last name, first name, full shipping address or pick-up point, email address and telephone number.

The CUSTOMER agrees to protect the security of his login details and not to reveal or communicate them to any third party. PSG MERCHANDISING may not be held liable for any consequence resulting from the fraudulent or malicious use of such login details due to the fault or negligence of the CUSTOMER.

When creating the CUSTOMER account, the CUSTOMER enters the data that are used to identify them under its sole responsibility, control, and direction, and hereby agrees to provide complete, accurate, and up-to-date information, and not to steal the identify of a third party.

The CUSTOMER is fully responsible for his data, for errors he may make using them, and for the damages that may result therefrom.

The provision of the CUSTOMER's personal data required for the processing and shipment of Orders is mandatory.

c-Confirmation

The CUSTOMER has the option, before confirming the Order, to verify the details and total price for the Order and to correct any errors, before conforming the Order for its acceptance.

After viewing a summary, the CUSTOMER shall confirm their Order by clicking on the “Confirm my Basket” button.

After confirming payment, PSG MERCHANDISING will send the CUSTOMER a confirmation email for his Order, restating all of these observations.

Another email will inform him of when the Order is shipped.

When the CUSTOMER confirms the Order, he thereby warrants that he accepts all of these Terms and Conditions of Sale and of the Personal Data Protection Policy.

PSG MERCHANDISING recommends that the CUSTOMER retains such emails in paper or electronic form.

The transfer of ownership of the items to the CLIENT shall not take place until the full collection of the price by PSG MERCHANDISING and of the receipt of the items by the CUSTOMER.

The CUSTOMER may view the processing status for the Order by logging in to his dedicated customer space on the Site.

d-Payment

After confirming the content of the Order, the CUSTOMER will definitively confirm it through the payment.

The Order will not be final until the payment of the corresponding price (price for the Order and the associated fees).

The payment methods currently accepted are indicated on the Site.

For payment cards, the CUSTOMER shall provide the number on his bank card along with its expiration date and the 3 (three) digit code on the back of his bank card or the 4 digits on the front of the American Express card.

The CUSTOMER has the option to save his bank card number and its expiration date for future Orders. In that case, only the 3 (three) digit code on the back of the bank card or the 4 (four) digits on the front of the American Express card will be requested when paying for the Orders.

At no time is PSG MERCHANDISING in possession of the full card number that the CUSTOMER has entered.

In order to ensure the security of payments made online, the Site uses the Adyen and SIPS secure payment services from ATOS. These services include the SSL (Secure Socket Layer) security standard. Confidential data (16 digit bank card umber, expiration date and CVV code) are sent encrypted over the SIPS server without being transmitted over the physical PSG MERCHANDISING server.

The ADYEN payment interface uses the 3D Secure technology. This is a system developed by two bank card networks, Visa and MasterCard, to authenticate the holders of bank cards and thus prevent any fraudulent bank card use. In addition to the number, expiration date, and CVV code, with the 3D Secure system, the card holder must login to their bank’s interface, to which they are automatically redirected, by filling out a code or personal information that their bank will have sent to them beforehand. Once authenticated, the card holder’s transaction will be authorised or rejected by their bank.

When the bank account details are confirmed, the secure remote payment manager will send an authorisation request to the bank card network.

The remote payment manager issues an electronic certificate.

The electronic certificate issued by the remote payment manager shall serve as proof of the transaction date and amount, in accordance with Articles 1365 et seq. of the French Civil Code, as well as the electronic archiving resources implemented by PSG MERCHANDISING. In this respect, the server dates and times will serve as evidence between the Parties.

The CUSTOMER hereby warrants that he is fully authorised to use the payment card provided for the payment of the Order and that card has access to sufficient fund to cover the resulting costs of that Order.

In all cases, the payment for the Order implies the signature and express acceptance of the Order, including its price.

The CUSTOMER also hereby agrees that the PSG MERCHANDISING systems recording the Order serve as proof of the nature of the agreement and its date.

2. ORDER REJECTION/CANCELLATION

In the event of a false declaration, particularly when the billing information is incorrect or impossible to verify, or in the event of a fraudulent use of payment methods, the payment for the Order may be suspended for three (3) days starting from the sending by PSG MERCHANDISING to the CUSTOMER requesting a correction. If, following this time period, the situation is not corrected, PSG MERCHANDISING may then cancel the Order.

PSG MERCHANDISING also reserves the right to cancel any Order from a CUSTOMER with whom payment is in arrears or there is a dispute regarding the payment for a previous Order, or for any legitimate reason, particularly regarding the abnormal nature of the Order.

It is hereby recalled that Orders placed on the Site are reserved for CUSTOMERS for their own use (or gifts) and not for resale. Consequently, and in accordance with Article L. 121-11 of the French Consumer Code, PSG MERCHANDISING reserves the right to limit the Order to a certain quantities per product, per CLIENT (the ordering of certain items may be limited to one (1) of the same product), particularly for limited editions. Generally speaking, PSG MERCHANDISING reserves the right to reject any order that is abnormal in nature, particularly in the event of orders in quantities and/or monetary totals that are unusual for an end consumer.

Orders from professionals will not be honoured by PSG MERCHANDISING.

PSG MERCHANDISING reserves the right to refuse a type of flocking on an item that would be degrading, pornographic, or any other type that may harm the Club’s reputation and image.

3. ITEM DESCRIPTIONS

Items offered for sale on the Site are those described and whose photos are contained on the Site.

PSG MERCHANDISING uses the greatest care and accuracy in the presentation and description of the items, within the limits of technology and in compliance with the highest market standards. However, it is possible that insignificant errors may be featured on the Site, which the CUSTOMER hereby acknowledges and accepts.

In any case, in the event the product shipped does not comply with its description on the Site, it shall be up to the CUSTOMER to implement the “warranties” clause below.

The CUSTOMER shall have the option of obtaining additional information by calling 09 69 32 21 62 (toll-free call, excluding any operator charges).

The items offered for sale on the Site are compliant with current French legislation. PSG MERCHANDISING’s liability may not be incurred in the event of non-compliance with the legislation of the country to which the item is shipped (e.g., in the event a product is banned, etc.). It shall be up to the CUSTOMER to check with the local authorities of the shipping country regarding the possibility of importing or using the products and services he would like to order.

PSG MERCHANDISING cannot guarantee that the information contained on the item packaging is translated into all of the languages of the European Union and/or the world. However, such information will available at least in French and/or English.

4. AVAILABILITY

The items offered for sale on the Site are valid solely within the limit of available stocks.

As an exception, in the event of the total or partial unavailabilty of the item after the Order is placed, the CUSTOMER will be informed by email that he has the option of seeking the shipment of a partial Order or to cancel the Order. In the latter case, the CUSTOMER will be reimbursed for the price of the item ordered within fourteen (14) days following the Order cancellation date.

5. PRICES

Prices are expressed in Euros and include the VAT at the rate in effect as of the Order date. The sale price of items is subject to change by PSG MERCHANDISING at any time. This change will be reported to the CUSTOMER before all Orders.

PSG MERCHANDISING hereby informs the CUSTOMER that an error may affect the price. In accordance with applicable French regulations, PSG MERCHANDISING reserves the right to cancel any Order in the event of an error in display or a technical error making the price of the Order obviously low or derisory.

The CUSTOMER shall also pay, in addition to the price for the items ordered, a flat-rate shipping and handling fee for the Order, the amount of which is displayed to them before the final confirmation of the Order. Since the shipping and handling fee may be changed at any time by PSG MERCHANDISING, it is recommended that the CUSTOMER regularly consult the “DELIVERY & RETURNS” section of the product description on the Site.

The CUSTOMER shall bear for the telecommunications costs involved in accessing the Internet and using the Site.

5. SHIPPING

a-Shipping Address

Items will be sent to the shipping address that the CUSTOMER indicates during the ordering process. Thus, it is the CUSTOMER’s responsibility to exactly provide all clarifications necessary to the proper routing of the Order.

The CUSTOMER may choose shipping to the address they have indicated on the Site during the ordering process or to a pick-up point.

Shipping and handling fees include taxes. The CUSTOMER’s shipping and handling fees depend on the shipping method selected, which is restated during the My Delivery step of the online ordering process, before confirming the shipping address.

PSG MERCHANDISING ships items to metropolitan France, Corsica, the French overseas departments and territories, and to a large number of foreign countries, a thorough list of which is contained in the Delivery Information section on the Site.

The CUSTOMER has the option to track the Order on the CUSTOMER account.

In the event the CUSTOMER is not present at the time of delivery, at the address indicated by the CUSTOMER, a delivery notification will be left in the mailbox informing them of the terms of retention of the package and its availability under the shippers sole and exclusive responsibility it is then possible for the CUSTOMER to pick up the package at a Post Office within 15 business days following the delivery of this notice.

After the above time period, the package will be sent back to PSG MERCHANDISING.

Customer service may contact the CUSTOMER for a possible re-shipment of the package at the CUSTOMER's expense. If no response is received from the CUSTOMER within a period of 30 days, PSG MERCHANDISING will issue a refund after the receipt of the package at its warehouses, with the exception of customised items.

PSG MERCHANDISING may in no case be held liable in the event of a late delivery or non-delivery due to incorrect contact information transmitted by the CUSTOMER, and particularly due to a false or inaccurate address or one to which delivery would be impossible.

PO box addresses are not accepted.

c-Shipping times

The delivery of the item(s) ordered will occur within the time periods specified on the Site prior to confirmation of the Order or, failing that, within 30 days starting from the day following the Order, subject to the full payment by the CUSTOMER of the price for available items.

The shipping times start to run from the receipt by the CUSTOMER of the Order confirmation email.

In the event of a late delivery, the CUSTOMER may cancel the Order under the terms and conditions provided for in Article L. 216-1 et seq. of the French Consumer Code.

In the event of a late delivery attributable to the CUSTOMER, particularly if the CUSTOMER is not present at the time of delivery, the provisions of Article L. 216-1 of the French Consumer Code will not be applicable.

d-Receipt of the delivery

Each delivery shall be considered completed when the item is handed over to the CUSTOMER, particularly by the shipper, as materialised by the control system used, such as the delivery tracking system provided on the Chronopost website. In accordance with Article L. 221-13 of the French Consumer Code, the CUSTOMER will receive, with the delivery, the delivery slip summarising the Order.

CUSTOMER may also view and downloads an invoice breaking down the price of each of the items and the shipping costs paid, which may be viewed directly in the Customer Account in the “See my Orders” section, by clicking on the “See Invoice” and “Download Invoice” links.

The transfer of risks takes place at delivery, at the time the items are handed over.

The CUSTOMER is expressly informed that he is responsible, at the time of delivery of the items, to verify their general condition (damage, etc.) and to make sure that it matches the Order (number, etc.). If not, the CUSTOMER is hereby advised to share his comments or express written reserves within three (3) business days following the receipt of the Order to the shipper and/or to PSG MERCHANDISING through Customer Service or using the contact form on the Site.

The PSG MERCHANDISING Customer Service department may request any information regarding the CUSTOMER’s identity and conduct any useful verification at that time.

If the package appears empty, the CUSTOMER should not accept the package and contact Customer Service immediately.

In all cases, the provisions listed in Article 8 on legal warranties shall apply. Where applicable, the CUSTOMER may also exercise the right of retraction during the cooling-off period mentioned below.

6. Right of withdrawal/Cooling-off period

 

In compliance with Article L. 221-18 et seq. of the French Consumer Code, the CUSTOMER may exercise his right of withdrawal and request a refund for their Order within a period of thirty (30) days, without having to provide justification.

Any withdrawal expressed after the 30 days period mentioned above shall not be accepted.

Products excluded from the right of withdrawal:

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal provided for distance sales may not be exercised for contracts:

(i) for the supply of goods made according to the consumer’s specifications or clearly personalised or which, due to their nature, cannot be re-shipped or which are susceptible to deteriorate or become outdated quickly.

(ii) for the supply of goods that were unsealed by the consumer after delivery and which cannot be sent back for reasons of hygiene or health protection.

As a consequence, the CUSTOMER is hereby informed that the right of withdrawal is not applicable to sales of items personalised at their request (e.g., jerseys personalised by flocking the name or number or any other specification). However, this restriction does not apply to items personalised using the name and number of a player offered on the Site.

Likewise, the CUSTOMER is hereby informed that, for reasons of hygiene, the return may be refused and the right of withdrawal may not be applicable to underwear and bathing suits if on said products the adhesive tape was removed or if the item is stained or has been worn.

It is hereby specified that, in the case of a gift, the right of withdrawal shall remain the CUSTOMER’s exclusive benefit and cannot be exercised by the recipient of the gift.

7. Return terms and conditions

a)     How to make a return request

PSG MERCHANDISING recommends that the CUSTOMER follow the return procedure indicated in the Returns and Exchanges section on the Site.

                          i.          Returns using the customer space on the Site

The CUSTOMER may make a request to return the Order from the Customer area by going to “Track my Orders.” CUSTOMER may then make a request for a credit or a refund for the Order.

The CUSTOMER shall select the item or items he wants to return and click on “Confirm request for refund/credit.”

The CUSTOMER will receive an email acknowledging receipt of the return/credit request.

The email containing a return shipping label that the CUSTOMER will have to use to return the item(s) is sent automatically when the return/credit request is confirmed by Customer Service.

                         ii.          Contacting Customer Service

The CUSTOMER may make a request to return the order by contacting Customer Service, the contact information for which is in Article 8 of the Terms and Conditions of Sale, which will explain the procedure to follow.

                       iii.          Return by any means

The CUSTOMER also has the option to request the return of the item(s) by sending an unambiguous declaration (particularly by using the retraction form attached to these Terms and Conditions of Sale duly filled out, or using the contact form available on the Site, indicating his contact information and Order number).

The burden of proof of the effective exercising of the right of withdrawal falls on the CUSTOMER. Thus, it is recommended that the CUSTOMER make his return request by registered letter with acknowledgement of receipt.

 

If the CUSTOMER sends the items back directly using his own means, the shipping costs will remain payable by the CUSTOMER. Items must be sent back in their original packaging to the following address:

In this case, the return by the CUSTOMER of the items will be carried out at the CUSTOMER’s risk and peril. The transfer of risks will not be effective until the receipt of the item(s) by PSG MERCHANDISING and a verification of its (their) condition.

 

However, it is recommended that the CUSTOMER contact Customer Service to inform it, which may issue the refund where applicable.

 

The refund/credit request cannot be taken into account if you return the item(s) directly without informing customer service.

b)     Time limit applicable to all return methods

The CUSTOMER shall return the product(s) without excessive delay and, in any case, within thirty days at the latest after communicating his withdrawal decision.

This time limit will start to run from the receipt of the item(s) ordered. In the event of an Order for multiple items delivered separately, whose delivery is staggering, the time limit starts to run from the receipt of the last if the items ordered.

The time limit shall be considered respected if the CUSTOMER has returned the item before the expiration of the thirty days time limit.

c)     Item condition

The items must absolutely be returned in a condition appropriate for resale (products in perfect condition and in their original packaging, with accessories, tags, etc.).

The CUSTOMER’s liability is incurred only with regard to the depreciation of the good resulting from handling other than that required to establish the nature, characteristics, and proper functioning of the good.

d)     Refund or credit

The refund will be issued immediately, in the form of a credit or refund, at the CUSTOMER’s choice, and in any case within 14 days starting from the date on which PSG MERCHANDISING receives the notification of the right of withdrawal being exercised. Nevertheless, the refund will be suspended until the occurrence of the first of the following two events: (i) the receipt of the items or (ii) the receipt of the necessary shipping supporting documentation.

When the package is received by PSG MERCHANDISING, the CUSTOMER is informed that the refund has been issued or, if the CUSTOMER has chosen a refund in the form of a credit, that the latter is available at his customer space.

After verification and where applicable an expert evaluation of the item, the refund will be issued using the same payment method used for the purchase.

If the CUSTOMER chooses a refund in the form of a credit, the refund amount will be credited to the customer account.

If the Order is returned in full, PSG MERCHANDISING will refund the CUSTOMER for the full price of their Order including shipping costs based on the shipping rate that PSG MERCHANDISING charged to the CUSTOMER.

If the Order is not returned in full, (the CUSTOMER keeps one or more items from the Order), PSG MERCHANDISING will solely refund to the CUSTOMER the price of the product(s) returned, but shipping costs will remain payable by the CUSTOMER.

However, if the item is returned due to the responsibility of PSG MERCHANDISING (defect or non-conformity of the product(s)) the shipping costs will be refunded based on shipping rate that PSG MERCHANDISING charged to the CUSTOMER.

The refund or customer account credit will take into account any discounts that may have been granted when the Order was placed by the CUSTOMER.

e)     Right of withdrawal and returns of Orders shipped outside France

For Orders placed outside of the European Union and for which customs duties have been billed to the CUSTOMER, PSG MERCHANDISING will not refund the customs duties.

If the CUSTOMER ordered items from a country other than France using the Site and would like to exercise his right of withdrawal, the CUSTOMER may not use the return shipping label and will be responsible for return shipping costs.

However, PSG MERCHANDISING will refund the CUSTOMER for the full price of their Order including shipping costs based on the shipping rate that PSG MERCHANDISING charged to the CUSTOMER.

8. LEGAL WARRANTIES - CONFORMITY

The CUSTOMER is hereby reminded that he shall ensure that the delivered items are compliant with the Order.

If the items delivered do not conform to the Order, the CUSTOMER shall inform Customer Service of this and return the items in question under the terms and conditions of Article 7, Return Terms and Conditions, of these Terms and Conditions of Sale.

In accordance with current regulations in effect, PSG MERCHANDISING furthermore agrees to comply with its legal obligations regarding warranties attached to items sold on the Site and which are contained in Articles L. 217-4 to L. 217-3 of the French Consumer Code and in Articles 1641 to 1648 and 2232 of the French Civil Code, allowing the CUSTOMER to send back defective items delivered or those that do not conform with the Order.

Thus, it is recalled, from the following articles of the:

- French Consumer Code:

“The seller is required to deliver goods which comply with the contract of sale and is accountable for any lack of conformity at the time of delivery. The seller is also accountable for any lack of conformity resulting from the packaging or from instructions for mounting or installation when the seller is contractually responsible for same or when it is carried out under the seller’s responsibility. To comply with the contract of sale the goods must:

 

1) Be suitable for the purpose usually associated with such a product and, where appropriate:

·       correspond to the description given by the seller and have the qualities shown to the purchaser in the form of a sample or model;

·       have the qualities that a purchaser might legitimately expect in view of public statements made by the seller, the manufacturer or its representative, particularly in advertising or labelling;

2) Or have the characteristics defined by mutual agreement between the parties or be suitable for any special requirement of the buyer, brought to the knowledge of and accepted by the seller. ”The action resulting from lack of conformity is limited to two years after delivery of the goods.

The CUSTOMER shall have a period of two years starting from the delivery of the good to take action and may choose between the repair or replacement of the good, subject to the cost terms and conditions provided for by Article L. 217-9 of the French Consumer Code.

The CUSTOMER is excused from providing evidence of the existence of the conformity defect of the good in the twenty-four months following the delivery of the good.

The CUSTOMER may decide to implement the warranty against hidden defects for the good sold within the meaning of Article 1641 of the French Civil Code. In this case, the CUSTOMER may choose between the cancellation of the sale or a discounted sale price, in accordance with Article 1644 of the French Civil Code.

- French Civil Code:

The seller warrants the goods sold against hidden defects which make them unsuitable for their intended purpose, or which reduce their possible use to such an extent that the purchaser would not have bought them or would have paid less, had they known.

 

Article 1648 of the Civil Code: “Any action resulting from latent defects must be instituted by the purchaser within two years of the discovery of the defect. In the case set out in article 1642-1, the action must be instigated, under pain of debarment, within one year of the date on which the seller can be discharged from liability for visible defects or lack of conformity.

 

It is hereby specified that the warranties shall not apply to the normal wear of certain parts or items, nor in the case of professional or collective use, nor to damage caused by causes external to the items.

These provisions are not exclusive of the right of withdrawal referred to in Article 6 of these Terms and Conditions of Sale.

8. CUSTOMER SERVICE

For any question regarding the tracking of an Order by the CUSTOMER or regarding after-sales service (returns, etc.) the PSG MERCHANDISING Customer Service may be reached at 09.69.32.21.62 (toll-free number) from France Monday through Friday from 10 a.m. to 7 p.m. or +33 9.69.32.21.62 (toll-free call, excluding any operator charges) from abroad.

The CUSTOMER may also make an information request on the contact form available on the Site, at the following address: https://store.psg.fr/fr/services/contact

The CUSTOMER may also contact Customer Service at the following email address: psg-serviceclient@psg.fr. It is recommended to the CUSTOMER, if the message is about an order, to provide his last name, first name and Order number, as well as the reason why he is contacting Customer Service.

9. INTELLECTUAL PROPERTY

Refer to the Legal Information section on the Site.

10. PERSONAL DATA - COOKIES

a. Personal data

Personal data are collected within the context of the distance sale which is mandatory, since such information is necessary for the processing and delivery of orders, as well as for preparing invoices. The CUSTOMER hereby warrants its accuracy. Such information is strictly confidential and is used by PSG MERCHANDISING or its subcontractors subject to the same obligations, in the context of the processing of orders placed in accordance with the Personal Data policy accessible here.

It is hereby recalled that the CUSTOMER has the right to access, correct, update and delete the data concerning himself or herself if it is inaccurate or incomplete. The CUSTOMER may request portability of this data. He or she also has the right to oppose the processing of this data or request that such processing be limited. Each CUSTOMER may also send Paris Saint-Germain his instructions for the retention, deletion, or communication of his data in the event of death and appoint the person who will be in charge of his data.

In order to exercise this right, the CUSTOMER can send a message, accompanied by proof of identity and specifying the address to which PSG Merchandising may respond, to the following email address: marketing@psg.fr or by mail to the following address: PSG Service Marketing - 53 avenue Emile Zola 92100 - Boulogne Billancourt. The CUSTOMER can also contact the Data Protection Officer by emailing the following address: dpo@psg.fr. A reply shall be sent within one month of receiving the request.

PSG MERCHANDISING will do its best to reply to all questions about its processing of personal data. In accordance with applicable regulations, the CUSTOMER is also entitled to file a complaint with CNIL (the French data protection authority) following the procedure outlined on its website (www.cnil.fr).

The CUSTOMER may receive informational emails from PSG MERCHANDISING about PSG MERCHANDISING products and promotional campaigns if the CUSTOMER has first given his consent by ticking the box provided for this purpose. The CUSTOMER retains the right to refuse such communications either beforehand by not giving their consent when confirming the Order, or afterwards by simply clicking on the unsubscribe link in any email or any communication that PSG MERCHANDISING sends to the CUSTOMER.

Furthermore, and in accordance with the French Act of 17 March 2014, the CUSTOMER can sign up for the do not call list on the website, www.bloctel.gouv.fr. This registration is free and the do not call list is imposed on all professionals excluding those with whom a contract is in progress.

b. Cookies

This Site uses cookies. Cookies are text files, stored on the computer, smartphone, or any other device used by the CUSTOMER and optimised for the Internet. Cookies only store information regarding browsing and the actions performed by the user on the Site. This information is sometimes attached to the CUSTOMER’s IP address.

In this case, PSG MERCHANDISING uses cookies to:

 

- Memorise the CUSTOMER’s preferences and settings, which change how the Site behaves or displays, such as the preferred language or the region where the CUSTOMER is located.

 

- Collecting and analysing statistics. It uses cookies to count the number of visits, unique visitors, page views, and to produce other general statistics on the activities of this Site and its services. These analyses make it possible to better manage this Site and to improve its performance.

 

- Logging in and authenticating a CUSTOMER When a CUSTOMER logs in to the Site, their unique login ID and the time they login are stored in an encrypted cookie on the CUSTOMER’s hard drive. This cookie enables the CUSTOMER to browse the pages on the Site without having to login again for each page. Those cookies will be deleted from the computer when the CUSTOMER logs out PSG MERCHANDISING also uses cookies in order to facilitate the login process. If the CUSTOMER does not allow these cookies, they will be subjected to less targeted advertisement.

A cookie will be installed and stored for a maximum of 13 months in the CUSTOMER’s memory or on their hard drive.

Each CUSTOMER may choose to accept the placement of cookies on his terminal and go back on that decision at any time by changing the settings on their web browser. Depending on the browser type, the CUSTOMER has the following three options: accepting or rejecting cookies of any origin or from a given origin, or programming the display of a message seeking his approval each time a cookie is deposited on their terminal. 11. FORCE MAJEURE

The performance by PSG MERCHANDISING of all or part of its obligations shall be suspended in the event of the occurrence of an act of god or force majeure event that prevents or delays performance of its obligations. Considered as such in particular, without this list being exhaustive, are war, riots, uprisings, social disturbances, and all types of strikes. PSG MERCHANDISING will inform the CUSTOMER of such an act of god or force majeure event within seven days of its occurrence. If that suspension continues beyond a period of fifteen business days, the CUSTOMER will then have the option of cancelling the Order in progress, and they would then be refunded under the terms and conditions listed in Article L. 216-3 of the French Consumer Code.

12. ARCHIVING

The archiving of Orders placed on the site totalling 120 euros or more and the corresponding invoices is carried out on a reliable, durable in order to represent a faithful, durable copy in accordance with Article 1348 of the French Civil Code.

13. APPLICABLE LAW – DISPUTES RESOLUTION

The Terms and Conditions of Sale are subject to French law, unless a more favourable provision exists in the CUSTOMER’s country of residence. The language of this contract is French. In the event of a dispute, only French courts will have jurisdiction.

PSG MERCHANDISING does everything it can to ensure the full satisfaction of its CUSTOMERS, and its Customer Service department is available to the CUSTOMER in order to provide information and handle any complaints.

In the event of a complaint regarding the Order, the CUSTOMER can contact PSG MERCHANDISING at the following address: psg-serviceclient@psg.fr.

Disputes that remain despite this prior attempt at an amicable solution may be subject to Consumer Mediation.

In pursuance of the provisions of the French Consumer Code concerning amicable settlement of disputes, PSG Merchandising subscribes to the e-commerce mediation service of FEVAD, the French e-commerce and distance-selling federation, whose details are as follows: 60 rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr ([http://www.mediateurfevad.fr/index.php/espace-consommateur). If a claim is not solved amicably by PSG Merchandising Customer Service, and after a prior written procedure with respect to PSG Merchandising, the Mediator Service may be consulted for any consumer dispute which has not been settled otherwise.

In accordance with Article L. 616-2 of the French Consumer Code, the CUSTOMER is also hereby informed of the existence of the platform put online by the European Commission, the purpose of which is to gather any complaints derived from an online purchase by European consumers and then send the cases received to the competent national mediators: this European out of court consumer dispute resolution platform is accessible at the address: http://ec.europa.eu/consumers/odr/.

If an amicable settlement cannot be reached, any dispute in which the Terms and Conditions of Sale may result shall be subject to the competent French courts.
